- Slips, trips and falls causing a variety of injuries.
- Burns, scalding and resultant scarring from spillage of hot drinks or food.
- Broken limbs, bruising or whiplash caused by luggage falling from overhead lockers.
Can I bring a claim?
Airline and tour operators owe a duty of care to their passengers to keep them safe from injury. Many of them have signed up to something called the “Montreal Convention” which actually operates in favour of airline passengers and imposes what’s called “a strict liability” on the air carrier; this means that you do not always have to show that someone was responsible for the accident. Simply the fact that the accident happened is often enough to bring an airline injury compensation claim.
What to do if you are involved in an Airplane Accident
To help prove that the accident happened and that another person was responsible for the airplane accident and your subsequent injuries, it is a good idea to try to make a note of the names, addresses and telephone numbers of any witnesses to the accident as well as to record it in the accident book. It can also benefit compensation claims if you are able to take some photographs of the accident site as well as soon as possible. There will be a first aider on the airplane and you can ask for a copy of their diagnosis and prognosis.
As with all personal injury claims, please take photographs of your injuries and visit a health professional who can give you advice and help you recover from your injuries more quickly.
Time limits on claims
It is important to pursue an airplane accident claim as soon as possible, as there are strict timescales in which you can bring these claims. If the Montreal Convention applies to your airline, this allows an injured person 2 years in which to make a claim for airline injury compensation.
