Defective Premises Injury
Property owners and their tenants are legally obliged to make sure that premises are maintained properly to prevent injuries to visitors to a house or premises. So, if you have been injured in an accident in premises owned by someone else which you have visited then you may have a claim for Personal Injury Compensation.
What are premises?
The law gives a wide definition of premises which can include house, shops, supermarkets, office buildings, car parks, parks and land.
The type of injury sustained in defective premises is usually due to faulty fittings and fixtures such as light fittings, handrails, escalators, lifts, machinery or even a faulty toilet!
What to do if you are involved in a defective premises injury
Often, property owners or their tenants will repair the defect following an accident, which means evidence can be hard to obtain so to help prove that another person was responsible for your accident and your injuries, so try to take plenty of photographs of whatever has caused your injury. It is a good idea to try to make a note of the names, addresses and telephone numbers of any witnesses to the accident. It can also benefit compensation claims if you are able to take some photographs of the defect as soon as possible and before it is repaired. You should also ask to record the accident in the accident book for the premises when you report the accident. It is a legal obligation to keep an accident book and record all accidents on the premises in it.
As with all personal injury claims, please take photographs of your injuries and visit a health professional who can help you recover from your injuries more quickly.
