Faulty Product Injury
When we buy goods, we expect them to have been manufactured safely and there are various laws which protect us if we suffer an injury due to faulty goods. The law says that if a person is injured by a faulty product and that injury wasn’t caused by misuse, then the injured person has a right to bring a claim for personal injury compensation – even if that person did not buy the product.
What types of products can be defective?
Any product has the potential to be defective and this is usually because the product has not been through the usual standard of quality checks. Common claims we have dealt with are:
- Electric shocks from faulty electrical goods.
- A variety of injuries due to failure of or badly designed mechanical parts, such as chairs, pushchairs and bicycles.
- Burns due to defective electrical products.
What to do if you suffer a Faulty Product Injury
To help prove that the product was defective and therefore responsible for your subsequent injuries, it is preferable to have the receipt or at least some proof of purchase such as a bank statement although not necessary. It can also benefit compensation claims if you are able to take some photographs of the faulty product as soon as possible which show how it has caused your injury to include the manufacturer and model number. You should also keep the packaging if possible or perhaps be able to find a picture of the packaging from the internet. This is so that we can trace the manufacturers and distributors of the product who can also be held liable with the retailer for a faulty product.
You can also claim for damage or loss of private property caused by faulty goods if the damage amounts to at least £275. There is no upper limit.
As well as obtaining the personal injury compensation you deserve, bringing a claim can help draw attention to the negligent manufacturer or retailer who can be fined or even imprisoned for the faulty goods by Trading Standards Services. You may be able to prevent others from suffering a similar injury. Where a particular product causes several injuries, the manufacturer should issue a product recall.

Time limits on claims
It is important to pursue a defective product personal injury claim as soon as possible, as there are strict timescales in which you can bring these claims. After an injury caused by faulty goods, you have up to three years to pursue compensation.
