Uninsured Driver Accidents
Sometimes you may find yourself involved in an accident with another vehicle that fails to stop or provide details and this could be because the driver is not insured. If you took a registration number and the uninsured driver can be identified you may still be able to claim compensation from the Motor Insurers’ Bureau (“MIB”) under their uninsured drivers agreement. If you are injured and the vehicle or driver cannot be traced then your claim will proceed under the untraced drivers agreement with the MIB.
This can be a complicated process especially in establishing with the MIB that you may claim under one of their agreements. The Motor Insurers’ Bureau will also deal with claims for compensation where it transpires that the other party did not have insurance in place at the time of the accident. Time limits on claims
It is important to pursue Uninsured Driver Accident injury claims as soon as possible, as there are strict timescales in which you can bring these claims. After a Road Traffic Accident Injury, you have up to three years to pursue compensation.
There is no limit to pursue an injury claim under the untraced driver agreement but, of course, the sooner it is done the better as evidence to prove the accident was not your fault may be required and this can be diluted or impossible to get over time.
